These Terms of Service (“Terms”) apply to the mobile games published by Games FunShots (“FunShots”, “we”, “us” or “our”), our website gamesfunshots.com and related services (the “Services”). By downloading, installing or using our Services you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Who can use the Services
You must be old enough to agree to these Terms in your country, or have permission from a parent or legal guardian who agrees to them on your behalf. If you allow a child to use our Services, you are responsible for their use.
License to use our games
We give you a personal, limited, non-exclusive, non-transferable and revocable license to download and play our Games on devices you own or control, for your own non-commercial entertainment. All rights not expressly granted to you are reserved by us and our licensors.
Virtual items and purchases
Our Games may let you buy virtual currency or items. Virtual items have no real-world monetary value, cannot be exchanged for cash and are licensed, not sold, to you. Purchases are processed by the app store you use (such as Google Play or the Apple App Store) and are subject to its terms. Except where required by law or by the app store's refund policy, purchases are final and non-refundable.
Advertising
Our Games are supported by advertising, including ads provided by third parties. Some Games let you watch optional ads in exchange for in-game rewards. How advertising uses data is explained in our Privacy Policy.
Rules of conduct
When using our Services you agree not to:
- cheat, use bots, hacks, mods or any unauthorized software, or exploit bugs;
- copy, modify, reverse engineer, decompile or create derivative works of our Games, except where the law expressly allows it;
- interfere with or disrupt the Services, their servers or networks;
- use the Services for any unlawful, fraudulent or harmful purpose;
- harass, threaten or abuse other people.
We may suspend or remove access, and reset progress or virtual items obtained through cheating or abuse.
Feedback and submissions
If you send us ideas, suggestions or feedback, we may use them without any obligation to you. Publishing submissions are handled confidentially and remain yours unless we agree otherwise in a separate written agreement.
Intellectual property
The Services, including all games, characters, artwork, music, software, logos and trademarks, are owned by Games FunShots or our licensors and are protected by intellectual property laws. Third-party trademarks belong to their respective owners.
Third-party services
Our Services may contain links to, or features provided by, third parties such as app stores, advertising partners and social networks. We are not responsible for third-party services, and your use of them is governed by their own terms.
Changes and availability
We continually update our Games. We may add, change or remove features or content, and may discontinue a Game, with reasonable notice where practical. We do not guarantee that the Services will always be available or free of errors.
Termination
You may stop using the Services at any time by uninstalling our Games. We may suspend or end your access if you break these Terms or if we are required to do so by law. Sections that by their nature should survive termination will survive.
Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the fullest extent permitted by law, Games FunShots will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us in the twelve months before the claim, or USD 50 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law.
Indemnity
To the extent permitted by law, you agree to indemnify Games FunShots against claims and losses arising from your breach of these Terms or misuse of the Services.
Governing law and disputes
These Terms are governed by the laws of the country in which Games FunShots is established, without regard to conflict-of-law rules. Nothing in these Terms takes away mandatory consumer rights you have under the law of your country of residence. Before starting any formal proceedings, please contact us so we can try to resolve the issue informally.
Changes to these Terms
We may update these Terms from time to time. We will change the “Last updated” date above and, for significant changes, notify you through our Games or website. If you keep using the Services after changes take effect, you accept the updated Terms.
